Governing law
All services provided by Bantu Plaza are governed by the laws of Botswana, including:
- Electronic Communications and Transactions Act, 2014 – governs online contracts, electronic signatures and consumer rights in digital transactions.
- Consumer Protection Act, 2018 – governs fair trading, refunds and dispute resolution.
- Data Protection Act, 2018 – governs the processing of personal data and the rights of data subjects.
- Cybercrime and Computer Related Crimes Act, 2018 – governs unauthorised access, harassment online and other cyber offences.
- Companies Act, 2003 – governs the corporate structure of the operator.
- Income Tax Act – governs record-keeping and tax obligations.
Dispute resolution
We aim to resolve every dispute directly. Where that is not possible, complaints can be referred to the Consumer Protection Office (Ministry of Trade and Industry, Botswana) or, for privacy matters, to the Information and Data Protection Commission. The courts of Botswana have exclusive jurisdiction.
If you’re a student (or a parent / guardian booking for a child)
These are the documents that govern your side of the deal – signing up, booking, paying, getting a refund.
- Terms of Service §3 (Eligibility), §4 (Bookings & payment), §5 (Cancellations & refunds) – 18+ to hold an account; minors 8–17 only via a parent / guardian account with a “Kids welcome” tutor; binding contract is between you and the tutor.
- Refund Policy – lessons are booked for set times; reschedule more than 12 hours ahead from your dashboard; if your tutor cancels or no-shows (attendance-checked) you get the full value back as account credit to rebook with any tutor, with a cash refund on request; trials are non-refundable once taken.
- Privacy Policy §2 (data we collect), §9 (children) – what we store about you, how long we keep it, your rights under the Botswana Data Protection Act 2018 (plus POPIA / GDPR / UK GDPR where applicable). Includes the safeguarding-recording policy for minor lessons (30-day retention; accessible only to you, the tutor, and our trust-and-safety team).
- Code of Conduct – For students & For parents / guardians – be punctual, be kind, give honest reviews, sit in the room or within earshot when a minor is having a lesson.
- Cookie Policy – the cookies we set today (login session + WC cart only), how to change your consent, what we may use in future.
If you’re a tutor (or are applying to teach)
These are the documents that govern your side of the deal – getting approved, teaching lessons, getting paid, staying eligible.
- Terms of Service §3 (Eligibility), §4a (Tutor earnings & commission), §4a (Payouts), §7 (Intellectual property) – 18+ baseline to teach, 21+ to teach learners under 18 (“Kids welcome”); commission rate (a flat 30%); bi-weekly manual PayPal payouts, off-platform via PayPal; lesson materials remain yours.
- Code of Conduct – For tutors & For tutors who teach learners under 18 – show up on time, deliver what you agreed; for Kids-welcome tutors: communicate only on Bantu Plaza, never off-platform contact with a minor, mandatory safeguarding escalation if anything looks off.
- Refund Policy – if a student cancels you receive 50% of the lesson fee as compensation (commission-free, added to your earnings); if you cancel or no-show, the student is made whole (full account credit, or cash on request) and you receive nothing; your attendance in the lesson room is recorded.
- Privacy Policy §2 (profile data we collect) – your bio, country, languages, hourly rate, availability, Kids-welcome opt-in, date of birth (for age verification).
- Cookie Policy – same cookies for everyone on the platform.

Right of withdrawal / Data subject requests
To request a copy of your personal data, correct it, restrict its processing, or delete your account – email info@bantuplaza.com from the address on your account. We respond within 30 days as required by section 23 of the Botswana Data Protection Act 2018 (and equivalent timelines under POPIA s.23 in South Africa, GDPR Art. 12 in the EU / UK, and CCPA in California).
